PGR proposes lawsuit against GST on internet purchases

BRASILIA - The attorney general of the Republic, Roberto Gurgel, filed a direct action of unconstitutionality (Adin) the Supreme Court (STF) against the collection of Tax on Circulation of Goods and Services (ICMS) by the State of Pará in sales by internet. To Gurgel, tax collection operations violates these constitutional provisions and may result in the withholding of goods tax barriers. Other states are also collecting


The GST on internet purchases originated in ICMS Protocol 21, 2011, which was signed by the Acre, Alagoas, Amapá, Bahia, Ceará, Goiás, Maranhão, Mato Grosso, Mato Grosso do Sul, Pará, Paraíba, Pernambuco, Piauí , Rio Grande do Norte, Roraima, Rondônia, Sergipe, Tocantins and the Federal District. They argue that most centers of production and distribution of industrialized is located in the South and Southeast, and therefore lose revenue from sales via the Internet or telemarketing.


For Attorney General, \"even if they are noble goals pursued by Protocol No. 21, the Member is not given the authority to modify the discipline\'s constitutional matter.\" According to him, in interstate operations in which the merchandise is destined to end consumer, only the home state jurisdiction to charge GST.
